Terms of Use

1. The provider

2. What this covers
These terms govern the use of the CMMS Perfect iOS app and the service that goes with it. By downloading and using the app, you accept them. If you do not accept them, do not use the service.
3. What we provide
CMMS Perfect is a machine maintenance register: adding machines, generating QR codes, reporting faults, keeping a maintenance history, and sending notifications. The service is cloud-based and requires an internet connection.
The service does not replace any safety inspections, regulatory reviews, or equipment logbooks required by law. Responsibility for these rests with the User.
4. Account and company
- Registration requires a real e-mail address. You're responsible for your password.
- Whoever creates a company becomes its owner: they can invite and remove members, and set up the subscription.
- The company is responsible for the company's data — including any uploaded photos.
- If you invite other users, you make sure they know and accept these terms.
5. Plans
The free plan can be used indefinitely, with up to 5 machines and 3 users. Fault reporting, photo attachments, and maintenance history are not limited in this plan either.
The Pro plan is available by subscription: unlimited machines and unlimited users.
6. Subscription — under App Store rules
- The subscription renews automatically until you cancel it.
- The fee is charged to your App Store account at the end of the period, within the 24 hours before renewal.
- You can cancel in your App Store account settings, at least 24 hours before the end of the current period. After cancelling, the service remains available until the end of the period.
- If the subscription includes a free trial, any unused portion is forfeited if you purchase a paid subscription for the same product during the trial.
- Handling the purchase, billing, and refunds is Apple's responsibility. Refunds must be requested from Apple; the Provider cannot refund any money.
- The Provider may change the price. Apple will notify you of the change, and you can decide to cancel before the renewal.
7. What happens when the subscription ends
Your data stays and remains readable. The free plan's limits only affect adding new machines and new users — your already-recorded machines, fault tickets, and the full maintenance history remain accessible.
8. Acceptable use
You may not use the service to:
- upload unlawful, offensive content, or content that infringes someone else's rights,
- access, or attempt to access, another's data without authorization,
- disrupt the service's operation or overload it with automated tools,
- reverse-engineer the service or create a derivative work from it.
In the event of a serious breach of these terms, we may suspend or terminate the account, with advance notice where circumstances allow.
9. Availability
We aim to keep the service continuously available, but we do not guarantee uninterrupted operation. Outages may occur due to maintenance, a provider fault, or force majeure.
10. Liability
The service is provided "as is." To the maximum extent permitted by law, we exclude liability for lost profits and for indirect or consequential damages. Our liability may in no case exceed the amount you paid for the service in the 12 months preceding the claim.
This limitation does not affect liability for intentional harm, for a breach of contract causing death or personal injury, or for any rights consumers are granted by law.
11. Intellectual property
All intellectual property rights in the app and the service belong to the Provider. Data your company enters remains yours; we use it solely to provide the service.
12. Privacy
The processing of personal data is governed by the Privacy Notice.
13. Changes
We may amend these terms. We'll notify you of material changes in the app or by e-mail. Continued use after a change constitutes acceptance of the terms.
14. Governing law
The contract is governed by Hungarian law. In the event of a consumer dispute, you may also turn to the Budapest Conciliation Board, or use the European Commission's online dispute resolution platform.
15. Provisions relating to Apple
This agreement is between you and the Provider, not Apple. Apple is not responsible for the app or its content. The Provider alone is responsible for the app and for support. Apple and its subsidiaries are third-party beneficiaries of this agreement and are entitled to enforce it against you.
